Zardari dual office case resurfaces in SHC

The petition filed in the SHC states that the president is not allowed to hold two offices.

The Sindh High Court (SHC), on Tuesday, recommended a one-member judicial bench to hear a?petition challenging President Zardari’s holding of dual offices.

The petition, which was?filed by?advocate Rasheed Akhund,?states that the president?of Pakistan is not entitled to hold two offices. The petition demands the president to vacate one of these seats to remain legal.

The three member judicial bench to hear the case, as recommended by the Sindh High Court, comprises Justice Musheer Alam, Justice Gulzar Ahmed, Justice Maqbool Bakar.

The case of the president’s dual offices had earlier been taken up by the Lahore High Court (LHC) and hearings have been conducted based on a petition filed by Pakistan Lawyers’ Forum President AK Dogar in the LHC in October last year. A similar petition filed by Dogar on October 4 this year triggered speculations among legal experts and analysts that a “legal and political controversy” may be in the offing.

The case pertaining to the dual offices of the president holds that the president’s holding of two offices is in violation of the constitution and amounts to high treason. Legal experts say that the real PPP is registered in the name of Pakistan Peoples Party Parliamentarians in the Election Commission, and that the president cannot hold the office of the President and PPP co-chairperson.
